WAI 88 NO Longer Called A Marae Claim

Te Āti Awa mai i Kukutauaki ki

Whareroa claimants WAI 88
"As will be discussed further in the sub-section dealing with Terminology, there has been much debate around the nomenclature to be used to describe the respective claimant groups. For the purposes of this report, a certain position has been adopted which is explained below. For now, it is noted that although the Tribunal Directions and Project Brief originally used the term Te Ātiawa/Ngātiawa ki Whakarongotai, this has been altered in accordance with claimant perspectives"
Ngātiawa - Te Atiawa Scoping Report Draft 20 Oct 2015 released by Waitangi Tribunal today,  225 pages long ask your representatives Ani and Damian Parata for a copy.
WAI 88 for Parata - Nohorua Whanau Only, according to WAI 88 claimants Ani and Damian Parata Marae loses again.
At least we have been given fair warning of what the exclusive WAI 88 claimants are up too, interesting really.  We watch the word play and listen.

Whāia Te Ahi Kā : Ahi Kā and its role in hauora Author: Kiri Parata - Te Atiawa ki Waikanae, Ngāti Toa Rangatira, Ngāti Raukawa, Ngāti Ruanui. New Zealand
(Topic) Hauora is enhanced and strengthened when whānau are actively participating in iwi and marae activities.
(Context) In our small coastal iwi, Te Atiawa ki Waikanae, many of our whānau live outside our rohe, indeed we have a large population living overseas.
Yet still our iwi members make a concerted effort to either come home on a regular basis or be engaged in iwi activities through social media and other avenues.
In this small qualitative study we sought to understand the level of whānau participation in iwi and marae activities and whether this has changed over time. (Methods) A broad range of whānau were interviewed ensuring we had wide representation from those living in different geographical locations and good age and gender variations. Whānau with differing levels of participation were sought to be part of the study. The recruitment of participants was unusually easy as many whānau put themselves forward to participate. We sought to discover how engagement impacts on the health and wellbeing of the individual and their whānau. Early impressions of the data collected highlighted the emergence of key themes important to our people. Indigenous Potential (theme) will soar when we work together and manaaki each other, recognizing that differing approaches can be adopted to reach a common goal. (Findings) Our ahi kā, those people who have remained locally to keep the home fires burning, are our backbone, upholding tikanga for manuhiri (guests) whilst maintaining kaitiakitanga (stewardship) over our rohe (local area). (Main message) Whāia Te Ahi Kā has highlighted the need to support our ahi kā, our local families, creating opportunities to ensure our own people are flourishing and maintaining optimum health. Being engaged in iwi activities is not a choice, rather a way of life that cannot be separated from other components of everyday life.
One of Kaumatua Interviewed WAI 88 Claimant Ani Parata
Summary (for use in the Programme if selected) Indigenous Potential: ‘Whāia Te Ahi Kā – Ahi Kā and its role in hauora’ shares the stories from one small iwi (tribe) of how active participation in marae and iwi activities impacts on the health and wellbeing of the individual and their whānau (family) in a positive way, enhancing connectedness and a sense of belonging.

Te Atiawa ki Whakarongotai Marae Trustees Caught in Legislation Breaches

The Parata Te Atiawa ki Whakarongotai Marae Trustees also lose credibility again.

According to Trustee's Duties "A Guide" Te Ture Whenua Maaori Land Act 1993 p.14.  Marae trustee's are also bound by Charitable Trust Act. Anne-Maree Ellison/Parata-Bukholt is not permitted to be a Marae trustee.
Another "clerical error" by Mr Carter JP, is not an acceptable excuse for the Atiawa ki Whakarongotai Charitable Trust or the Parata - Toa, Raukawa, Atiawa ki Whakarongotai Marae Trustees.
The Marae Chairman well it is common knowledge he needs serious help, the Treasurer for both organisations an illegal trustee.  Who if honourable would have declared her situation in 2013.
Call it what it is blatant dishonesty with intent, ignorance and arrogance again.  Ironically, majority of Marae trustees and all of Charitable Trust Trustees and company directors.  Support for dishonesty, bullying, lateral violence and legistlation breaches is astonishing.  With these two trust's and they dragged KCDC - Toa-Raukawa-Atiawa Whakameinga Komiti and  A.R.T Confederation in there with them.
As Ngaatiawa Iwi ki Kapiti are entering into a higher lever phase of Treaty Claim discussions with updated "Statements of Claims."  An announcement in October 2015 by Tribunal will clarify this statement.
We give thank's the Min of Justice "Waitangi Tribunal" and "Office of Treaty Settlements" are bound by legislations and laws.  However, imperfect they are, it's a baseline to maintain a degree of dignity and integrity.

Atiawa ki Whakarongotai Charitable Trust Illegal Trustee Updated 14/09/2015

Atiawa ki Whakarongotai Charitable Trust have done it again.  They have operated with a Trustee who since 2013 does not qualify.

As a Justice of Peace Bill Carter, should know when he registers a trustee they need to qualify under the Charities Act.
Anne-Maree Ellison Bukholt owned 50,000 shares of 100,000 of this "body corporate that is being wound up, is in liquidation or receivership, or is subject to statutory" click link document 1 of 2 Nu Image Interiors doc #2 Nu Link Final Liq Report
Anne-Maree the Treasurer for Te Atiawa ki Whakarongotai Marae Trustees and Atiawa ki Whakarongotai Charitable Trust (AWCT).  She has no right as AWCT representative on Kapiti Coast District Council (KCDC) - Whakameinga Komiti.
To tell Ngaatiawa Iwi ki Kapiti and Te Atiawa ki Whakarongotai Marae Trustees in front of a KCDC Councillors and staff  "No  Customary Water Rights will be discussed with KCDC at this meeting."  Ra Higgott fellow AWCT Trustee also agreed with this statement.
Issue the Marae NOT being charged water supply rates.  The letter KCDC and others are looking for, that sorts this issue out Ngaatiawa Iwi Treaty Claim researchers actually has a copy.
Councillors from this government department need to think about what they are doing and who they take their advice from click link KCDC  regarding the "Customary Rights" of Ngaatiawa Iwi ki Kapiti.  It is really evident they are happy to breach multiple legislations to listen to dishonest people.  AWCT a trust with "NO BENEFICIARIES."

Solid Evidence and Discrimination

Call the previous post rhetoric, ranting or ignore it can all be legally backed up with documentation.  Applicable to numerous legislation.

The human rights violations, stigma and discrimination historically and contemporary have been horrendous for Ngātiawa Iwi CT registered claimants.
Violations lead by the government politicians family Te Kakakura Stubbs (Wi Parata) and dedicated supporters of Ngati Toa, Raukawa, Mutunga-Atiawa and American ki Whakarongotai Iwi regime, previous Runanga Executives, Charitable Trust Trustees, current Trustees, Marae trustees, and Company Directors.

Ngātiawa Iwi Human Rights Violations Amended

Human Rights Violations

It is common knowledge the Te Rangitaake (Wiremu Kingi) Ngātiawa Rebels whanau have had their Human Rights violated since 1847.
Maori Friendly, Min of Parliament Te Kakakura Stubbs (Wi Parata) maintained the government's stance in this violation.  Mr Stubbs being on his mothers side Ngati Toa, Raukawa, Mutunga and fathers side - of American heritage.
The Ngati Toa, Raukawa and Atiawa ki Whakarongotai registered reservation, Marae Trustees, and Charitable Trust on Mr Stubbs land for the three iwi has maintained the overseeing oppression of Ngātiawa Rebels.
Ensuring the mokopuna of Ngātiawa Ariki Reretawhangawhanga, Te Rangitaake, Pirikawau, Paeroke, Pukerangiora, Henare Te Marau and Puketapu Hapū were kept in subservience as ordered by Gov. Grey since 1847.
Parata-Stubbs descendants has supported the government to breach the Human Rights of all who have only DNA Ngātiawa on the Kapiti Coast to this very day.
Three well known Nationally and International Indigenous Human Rights activists have been driving the WAI claim since 2002.  All mokopuna of the Chiefs of Ngātiawa rebels.
The increase of hits on this blog is partly due to the above three being observed by United Nations Officials, UNAID'S and Indigenous Human Rights Advocates, Global Fund donors, and governments around the world.  Marama (Rhonda) Pala nee Mullen is appointed as the Indigenous Spokesperson for Asia-Pacific, Canada (First Nations), USA and nine other Indigenous countries.
We identify in our Karanga and Mihi as Ngātiawa ki Kapiti te Taku Tai, around the world.  However, on our whenua our HUMAN RIGHTS continue to be violated by the Stubbs-Parata Ngati Toa, Raukawa and Atiawa ki Whakaraongotai Iwi and American regime, who reinforce government departments in 2015 to maintain the stigma and discrimination.  Against those with only Ngātiawa DNA.
Rawiri Jenkins-Evans, Marama (Rhonda) Pala and Apihaka (Irene) Mack, and registered members of Ngātiawa Iwi CT. Who have been in Treaty of Waitangi Judicial Conferences with WAI 1018, 609, 612 and 238 for seven years.   Will maintain asserting the right to have HUMAN RIGHTS in Waitangi Tribunal J.C and hearings to negotiations for Ngātiawa Iwi on their whenua.
Ngātiawa Iwi REJECTION FROM the Stubbs-Parata Ngati Toa, Raukawa and Atiawa ki Whakaraongotai Iwi regime,  who have refused to attend meetings organised by Ngātiawa Iwi representatives for the last five years.
Ngātiawa Rebels kept working on Treaty Claims we cannot be removed from the WAI process by anyone.  We have to give thanks for being displaced and forced to stand for our HUMAN RIGHTS.
For those who not believe what is written google Marama Pala as she will be one of the lead presenters and negotiators for Ngātiawa Iwi claims.   We work as a team Rawiri, Apihaka, Te Urutahi Waikerepuru, and Patrons Dr Huirangi Waikerepuru QSM, and Kuia Mere Broughton JP-QSM are her employers.  Everything we say and do is being scrutinized and being quoted by world leaders.  United Nations 2015 statement, International Day of the World's Indigenous Peoples words.  Co-Writer an claimant of WAI 1018 wrote and delivered at July 2015 IAS Conference in Vancouver.
Meantime on Kapiti Coast Ngātiawa Rebels tuturu WAI claimants are discriminated against by Stubbs-Parata Ngati Toa, Raukawa, Mutunga, American and Atiawa ki Whakaraongotai - Iwi regime classified as unacceptable humans.

Amendment 2 (AWCT) AGM September 2015 and 2012 Solictor Generals Report

Atiawa ki Whakarongotai Charitable Trust (AWCT) - AGM to be held at their offices in Elizabeth St, Waikanae.

It is a good time to be reminded of what Cherly Gwyn Acting Solicitor General (ASG) stated in 2012.

"8. This appears to have arisen out of a lack of understanding, on both sides, of the nature of a charitable trust and the obligations of the trustees. Rather, believe there was a lack of understanding of their obligations as trustees. This however is mirrored by on the part of Iwi members," written by ASG    -    (members duped!)
"A charitable trust different to a private trust in that a charitable trust has no beneficiaries."written by ASG
"While Iwi members will likely receive the benefit of the trust's charitable purposes," written by ASG (members have not benefited)
"do not have the same rights and entitlements as private beneficiaries, nor can expect the Trust Board to administer the trust in the same way that private trustees might." written by ASG
HENCE THE BLATANT DECEIT MARIA GRACE BATTLED AGAINST WHEN THIS TRUST DEED WAS AMENDED IN 2002. Thank you Maria for your wisdom and opening our eyes RIP our dear cousin. We thank your brother RIP Tony Thomas for helping us write and activating us to file WAI 1018 in 2002.
You were both RIGHT all of Iwi members Rights Stripped.  Yes, 13 years later, nothing has changed after 2 investigations and promises made to government officials by AWCT, broken.
9. "relating to the holding of Trust Board meetings and the AGM.  I do note however there is nothing in the Trust Deed requiring the Board to hold their non-AGM meetings in public or allow Iwi members to attend."written by ASG.
The 2nd detailed report received in 2013 from the Chief Ombudsman is evidence in WAI 1018 Ngātiawa, Porirua-Manawatū Waitangi Tribunal Hearing.
The reason over 1000 Ngātiawa Iwi whanau from the Kapiti Coast will not trust this individual serving Fisheries Mandated Charitable Trust.

Scope Report Waitangi Tribunal Historian Update

©August Hui arranged for Ngātiawa Tuturu WAI 1018 and 2228 to work on the historical scope report for Ngātiawa claimants.
The hapū of Ngātiawa Rebels almost forced into extinction by legislation and the Maori Friendly's Ordinance.
Ngātiawa Iwi is not part of the A.R.T Raukawa, Ngati Toa and Ati Awa Confederation that has enabled Toa and Raukawa to erode Ngātiawa 1834 and 1839 whenua boundaries.  Due to the recent presentation given by Raukawa at June 2015 Judicial Conference.  We have agreed not to get obsorbed into another Raukawa version of who we are as a people.
We are not a Raukawa Hapū and have no partnership agreement with Te Hono Claimants.
We assert the right to own our collective Hapū name Ngātiawa Iwi.
To the numerous immediate whanau who have been receiving internal whanau updates via social media private groups, will be notified when online registration forms are available.  Those already registered will be updated and passwords issued to gain access to confidential areas of www.ngatiawakikapiti.org - Thank you for your patience.  ©

Judicial Conference 30 Jun 2015

Mandated Muaupoko Tribal Counsel (MTC) and Direct Negotiations

A debate occurred between Waitangi Tribunal Judicial Conference (JC) - Adjudicators Judge Carin Fox and Honourable Sir Doug Kidd and Office of Treaty Settlements (OTS) Crown Counsel.  Regarding direct negotiations excluding the majority of Muaupoko claimants present.  Undermining the Waitangi Tribunal process.
OTS Crown Counsel has been asked this question by the JC Adjudicators; "will the Crown issue a statement confirming the Crown will not resume direct negotiations with MTA until all of the claims in Porirua ki Manawatū district inquiry have been heard and reported on?The answer is expected by 27 July 2015.
OTS Counsel was notified Ngātiawa ki Kapiti Coast claimants have the same issue.  OTS Counsel replied to WAI 1018 "with the Te Atiawa out there trying to go into direct negotiations."  WAI 1018 informed OTS Counsel Atiawa ki Whakarongotai Charitable Trust has "NO BENEFICIARIES" according to their trust deed and the 2012 Solicitor Generals report.  It's been like that since 2002.  He was astounded.
There currently is a joke going around Atiawa ki Whakarongotai Charitable Trust (AWCT), its company directors and members, and NZTA expressway employees that they will "let WAI 1018 do all the work and then AWCT will come in and take the credit and take over direct negoiations" to rip Ngātiawa tuturu of again.
We will watch and see what the JC Adjudicators and OTS Crown Counsel, registered Ngātiawa Iwi Charitable Trust whanau and our Barristers do with that manipulative-abusive and dishonourable behaviour.  The Crown will be held responsible should they let that theft occur again.

Raukawa and Te Ati Awa Team

No, Te Ati Awa WAI claims are identified in this document, advocated by Te Hono ki Raukawa, referred to as the Raukawa and Ati Awa Team.

Raukawa and Te Ati Awa Research Plan  click on link

Ngati Kauwhata stated today 22/06/2015 they were not part of the Raukawa Confederation, in a document filed to tribunal office.
As Ngātiawa ki Kapiti te Taku Tai is not part of the A.R.T Confederation.
This statement written in a report on the Atiawa ki Whakarongotai Charitable Trust states very clearly why we are not.
Written in Solicitor Generals 2012 Report:
It is stated, Damian Parata, Denise Parata. Tutere Parata, Daniel Mullen, Jack Rikihana, Bill Carter, "were all naïve."  In formulating the Atiawa ki Whakarongotai Charitable Trust “Trust Deed.”
"They were incompetent, had no understanding, experience or business skills to invest into any business scheme."
Furthermore, according to the Solicitor General, the trustees “did not have a sufficient understanding of the role of trustees of a charitable trust where there are no direct beneficiaries.”
“charitable trust where there are no direct beneficiaries"
All the same people with a couple of add on's control this trust today.   No changes have been made to constitution.
